Preamble

These General Terms and Conditions govern the contractual relationship between customers and Clemens Stockhammer for the purchase and sale of products via the online shop operated at www.space-clemens.com.

§1 Scope of Application

These Terms and Conditions apply to all business relationships between Clemens Stockhammer and customers in the version valid at the time the contract is concluded.

§2 Subject Matter of the Contract

Clemens Stockhammer offers vintage furniture and upcycled furniture pieces for sale via the online shop.

All products comply with the applicable safety regulations. Where required by law, products meet the relevant EU product safety standards.

Due to the nature of vintage and upcycled goods, signs of age, use, or material-specific characteristics may be present and are considered part of the product’s condition, unless expressly stated otherwise in the product description.

§3 Conclusion of Contract

The purchase contract is concluded once the customer places an order via the online shop and the order is confirmed by Clemens Stockhammer.

§4 Warranty

Statutory warranty rights apply.

For consumers, the warranty period is two (2) years from delivery of the goods.

For entrepreneurs within the meaning of §1 of the Austrian Consumer Protection Act (KSchG), the warranty period is twelve (12) months from receipt of the goods.

§5 Retention of Title

Delivered goods remain the property of Clemens Stockhammer until full payment has been received.

§6 Payment Terms

Available payment methods include Shopify Payments, bank transfer, SumUp, or cash payment, depending on the options offered in the online shop.

In the event of late payment, Clemens Stockhammer reserves the right to charge default interest at a rate of

5% p.a. above the base interest rate for consumers, and
9% p.a. above the base interest rate for entrepreneurs.

In addition, reminder fees of up to EUR 15 per reminder may be charged.

§7 Delivery and Shipping

Delivery is carried out by DPD or Austrian Post within the European Union.

Self-collection is possible by prior arrangement.

Average delivery times are:

Austria and Germany: 3–5 business days
Other EU countries and Switzerland: 3–7 business days

Delivery times may vary depending on the destination country, public holidays, or seasonal delays.

For deliveries to consumers, the risk of loss or damage passes to the consumer upon receipt of the goods.

For entrepreneurs, the risk passes upon handover of the goods to the shipping service provider.

§8 Right of Withdrawal

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.

The withdrawal period shall be fourteen days from the day on which you or a third party designated by you, who is not the carrier, takes possession of the last item delivered.

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. by email or letter):

To meet the withdrawal deadline, it is sufficient that you send your notification before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered), without undue delay and no later than fourteen (14) days from the day on which the returned goods have been received.

Refunds will be made using the same means of payment used for the original transaction, unless expressly agreed otherwise. No fees will be charged for the refund.

No Right of Withdrawal

The right of withdrawal does not apply to:

Goods made to customer specifications or clearly personalized, including custom-made or individually configured furniture pieces.

§9 Disclaimer of Liability

Clemens Stockhammer shall not be liable for damages resulting from improper or non-intended use of the products, including use contrary to instructions, unauthorized modifications, or use in unsuitable environments.
Liability for damages caused by improper handling, incorrect assembly, or misuse is excluded unless caused by intent or gross negligence.
Liability for indirect damages, consequential damages, or loss of profit is excluded.
Customers are obliged to use products properly and to observe all safety instructions provided.
Clemens Stockhammer shall not be liable for damages caused by force majeure.
Products comply with the applicable EU General Product Safety Regulation (GPSR). Relevant safety information is provided in the respective product descriptions. By purchasing, the customer confirms that these instructions have been read and observed.

§10 Data Protection

Clemens Stockhammer is committed to protecting customer privacy and treating personal data confidentially. Data protection practices are described in the Privacy Policy available on www.space-clemens.com.
To process orders, customers must provide personal information such as name, email address, postal address, payment details, and order information. This data is transmitted via Shopify and processed accordingly.
Customers who subscribe to the newsletter agree to receive regular information and offers by email. Consent may be withdrawn at any time via the unsubscribe link.

Personal data is processed on lawful bases, including:

Performance of the contract and customer support
Consent given by the customer
Compliance with legal obligations
Legitimate interests, provided these do not override the customer’s rights

Personal data is stored only as long as necessary to provide services or comply with legal obligations. As a rule, data is retained for five (5) years.
